Reinstating an Elected Insurance Commissioner — Protecting Florida Homeowners

WHY, Florida homeowners are facing historic increases in property insurance premiums, policy cancellations, and market instability.

WHY, families, seniors, small-business owners, and working Floridians risk losing their homes due to unaffordable and unstable property insurance.

WHY, the people of Florida deserve independent, accountable oversight focused first on homeowners and consumers, not insurance companies.

WHY, restoring an Insurance Commissioner elected by the people will create a true consumer watchdog with the authority to protect property owners statewide.

BE IT ENACTED BY THE PEOPLE OF THE STATE OF FLORIDA

This amendment reinstates the position of Florida Insurance Commissioner as an independently elected constitutional officer, chosen statewide by Florida voters during the general election cycle.

The primary mission of the Insurance Commissioner shall be to protect Florida homeowners and property owners. The Commissioner shall have full regulatory authority over property and homeowners’ insurance, including the approval, denial, and review of rates and company practices.

The duties of the Insurance Commissioner shall include:

  • Prioritizing consumer protection and homeowner relief.
  • Regulating property and homeowners’ insurance rates and policy forms.
  • Investigating unfair cancellations, denials, and predatory practices.
  • Promoting market stability while ensuring fair and affordable pricing.
  • Providing transparent, public reporting on the condition of Florida’s property insurance market.

This amendment removes appointment authority from the executive branch and restores direct elections by the voters of Florida. The Insurance Commissioner shall act independently and in the best interest of the people of Florida.

This amendment becomes effective upon voter approval and certification.

In response, this proposed constitutional amendment would reinstate a statewide elected Insurance Commissioner whose primary responsibility is to protect Florida homeowners and property owners. The Commissioner would have independent authority to regulate property and homeowners’insurance rates, investigate unfair practices, and provide transparent oversight, ensuring the insurance system works for consumers, not insurance companies.
